1. Acceptance of Terms

By accessing or using Embodifi, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. If you are accepting these terms on behalf of a child, you confirm that you are their parent or legal guardian and have the authority to do so.

2. Description of Service

Embodifi is a creative wellbeing platform that helps children express their emotions through storytelling. Our service includes:

• AI-powered story generation based on children's prompts
• Character creation
• Wellbeing insights and trends for parents
• Safety alerts for potentially concerning content

These features may change, improve, or be temporarily unavailable as we continue to develop and maintain the service.

3. User Accounts

3.1 Account Creation

By creating an account, you confirm that you are at least 18 years old or the legal guardian of the child using the service. Please note that we do not verify age at signup, and you are responsible for ensuring that accounts are created and used appropriately. You must also:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access

3.2 Child Profiles

Each parent account can create up to a maximum of two (2) child profiles. You are responsible for supervising your child's use of Embodifi and ensuring they use the service appropriately. You should involve your child in the profile creation process where appropriate, and you remain responsible for reviewing the stories and content they create or view.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt the service
• Share your account credentials with others
• Upload harmful, malicious, or exploitative content
• Impersonate others or provide false information

We may take appropriate action, including suspension or termination of accounts, if we reasonably believe these rules have been violated.

5. Content and Intellectual Property

5.1 User Content

You retain ownership of the prompts, ideas, and other content that you or your child submit to Embodifi. By using Embodifi, you grant us a limited, worldwide, royalty-free licence to use this content solely for the purpose of operating, maintaining, and improving the service, including generating stories and insights.

5.2 Generated Stories

Stories generated by Embodifi are created for your personal, non-commercial use. You may share these stories within your family or with trusted professionals (such as teachers or therapists), but you may not sell, redistribute, or commercially exploit them without our prior written permission.

5.3 Embodifi Property

All rights, title, and interest in Embodifi's platform, including our AI technology, interface design, content, and branding, remain our exclusive property. These Terms do not grant you any rights to use our trademarks, logos, or branding except as necessary to use the service.

6. Safety and Content Moderation

Embodifi uses AI to detect content that may indicate potential risks, such as self-harm, bullying, or abuse. However:

• Our system is not perfect and may miss some concerning content
• We may sometimes flag content that is not actually concerning
• We do not monitor content in real time
• Embodifi is not an emergency service. If you believe a child is at immediate risk, contact local emergency services or a qualified professional straight away.
• Parents and guardians remain ultimately responsible for their child's wellbeing and for reviewing their stories and activity.

7. Medical Disclaimer

Embodifi is a creative wellbeing tool and is not a medical device or mental health service. Our stories, insights, and alerts are for informational and supportive purposes only and do not constitute medical, psychological, or therapeutic advice. If you have concerns about your child's mental or emotional health, please consult a qualified healthcare provider.

8. Fees and Payment

Monthly Plan: Embodifi offers a monthly subscription plan for A$9.99 per month after a 14-day free trial, unless a different promotional or complimentary access arrangement applies.

No payment details are required to start the free trial. If you choose to subscribe, payments are processed by Stripe and automatically renew monthly until cancelled. By subscribing, you agree to:

• Pay all applicable fees for the monthly plan
• Provide accurate and up-to-date payment information
• Authorise automatic recurring monthly payments
• Use the service within fair-use limits designed to protect reliability for families
• Accept that fees are generally non-refundable except as required by law

You can cancel your subscription at any time through the billing portal. If you cancel, access remains active until the end of the current billing period, after which paid features will no longer be available unless you resubscribe or have complimentary access.

9. Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent, abusive, or illegal activity
• Your account has been inactive for an extended period
• We reasonably believe your continued use poses a risk to the safety or wellbeing of children using the platform

You may terminate your account at any time by contacting us at matthew@embodifi.com.au. Upon termination, your right to use Embodifi will end, but sections that by their nature should survive (such as intellectual property and limitations of liability) will continue to apply.

10. Limitation of Liability

To the fullest extent permitted by law, Embodifi and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our service or inability to access the service.

11. Changes to Terms

We may modify these Terms of Service from time to time. We will notify you of significant changes via email or through the platform. Your continued use of Embodifi after such modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions. You are responsible for complying with any local laws that apply to your use of Embodifi.

13. Service Changes and Availability

Embodifi is an evolving service. By using Embodifi, you understand and agree that:

• Features, layouts, and functionality may change at any time
• Occasional bugs, errors, or interruptions may occur
• We may contact you to request feedback that helps us improve the experience for families
• We may modify, limit, suspend, or discontinue parts of the service at our discretion
